ESIGN Consent & Disclosure

This is the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) consent and disclosure of Torque.ai Incorporated, a Delaware corporation operating as RunTorque (“we,” “us,” or “our”). When you affirmatively consent to receive electronic records, the following applies:

1. Your Agreement

By providing your consent, you agree that RunTorque and the Lenders to which your application is routed may deliver to you, in electronic form, all communications, disclosures, agreements, notices, and other records related to your credit application and any resulting financing. This includes, but is not limited to:

• Credit application disclosures
• Privacy notices
• FCRA disclosures, adverse action notices, and risk-based pricing notices
• Truth in Lending disclosures
• Retail installment contracts and other loan documents
• Account statements and notices
• Any other communications required by law to be provided in writing

2. Hardware and Software Requirements

To access and retain electronic records, you must have:

• A computer or mobile device with internet access
• A modern web browser (Chrome, Safari, Firefox, or Edge — current version)
• Software capable of viewing PDF files
• An email account that you check regularly
• A printer or sufficient electronic storage capacity to retain copies of electronic records

3. Paper Copies

You may request a paper copy of any electronically delivered record at any time by contacting support@runtorque.ai. A reasonable fee may apply for paper copies. Requesting a paper copy does not constitute withdrawal of your consent to receive electronic records.

4. Withdrawal of Consent

You may withdraw your consent to receive electronic records at any time by emailing privacy@runtorque.ai. Withdrawing consent may delay or prevent the processing of your application or the maintenance of your account. Withdrawal applies to records delivered after the date of withdrawal; records previously delivered electronically remain valid.

5. Updating Contact Information

You agree to notify RunTorque immediately of any change to your email address or other contact information by emailing support@runtorque.ai or by updating your account profile.

6. Electronic Signatures

Where you sign a document electronically through the RunTorque platform, you agree that your electronic signature has the same legal force and effect as a handwritten signature under the E-SIGN Act (15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act as adopted in applicable states.

In particular, when you electronically sign a retail installment contract or other financing document, you intend that your electronic signature constitute a legally binding signature under applicable state and federal law, including the Uniform Commercial Code § 9-105 as applicable to transferable records.

7. Effect of This Consent

This consent applies to all current and future records exchanged in connection with your relationship with RunTorque and the Lenders matched through our Service. Each Lender may have additional disclosures or consent requirements which will be presented to you separately at the time of the applicable transaction.
